These Terms & Conditions apply to your use of wbsa.org.au and your purchase of memberships, programs, products and other services offered by Wide Bay Sports Academy Inc. ABN 17 913 152 467, (“we”, “us”, “our”).
By placing an order or purchasing a membership through our website, you agree to these Terms & Conditions.
1. Memberships and Programs
We offer a range of athlete memberships and programs through our website. The specific inclusions, duration, price and payment arrangements for each membership are described on the relevant membership or checkout page.
Membership access is subject to these Terms & Conditions and any additional terms or requirements communicated to you at the time of purchase.
2. Payment Plans
Some memberships are offered as fixed-term weekly payment plans.
Foundation Athlete
The Foundation Athlete membership requires 16 weekly payments.
By purchasing Foundation Athlete, you authorise us to charge the credit or debit card provided at checkout for the applicable weekly payment amount until a total of 16 payments have been processed.
The payment plan will automatically end after the 16th scheduled payment. No further recurring payments will be taken under this payment plan unless you separately purchase or agree to another membership or service.
Performance Athlete
The Performance Athlete membership requires 26 weekly payments.
By purchasing Performance Athlete, you authorise us to charge the credit or debit card provided at checkout for the applicable weekly payment amount until a total of 26 payments have been processed.
The payment plan will automatically end after the 26th scheduled payment. No further recurring payments will be taken under this payment plan unless you separately purchase or agree to another membership or service.
Return to Perform
The Return to Perform membership requires ongoing payments. However, this is a custom length program and payments will be organised manually. Only a one-time payment is collected to agree to this membership.
Other Purchases
Products, services or memberships identified at checkout as a one-off purchase will be charged as a single payment to the payment method provided.
3. Recurring Payment Authorisation
When purchasing a membership with a recurring payment plan, you expressly authorise us and our payment provider to process the scheduled weekly payments using the payment method provided at checkout.
Before completing your purchase, the applicable weekly payment amount, number of payments and payment frequency will be displayed to you.
You are responsible for ensuring that the payment method provided remains valid and has sufficient funds available for each scheduled payment.
Your card details are processed through our third-party payment provider. We do not ordinarily have access to or store your complete card number.
4. Payment Schedule
The first payment will generally be processed when your order is placed.
Subsequent payments will generally be processed at weekly intervals using the payment method authorised at checkout.
The exact timing of subsequent payments may be affected by weekends, public holidays, payment processing requirements or your payment provider.
You will not be charged more than the number of scheduled payments specified for your membership unless you separately authorise another purchase or service.
5. Failed Payments
If a scheduled payment is declined, reversed or otherwise unsuccessful, we may attempt to process the payment again using the payment method you have provided.
We may contact you to request an updated or alternative payment method.
Where a payment remains outstanding, we may suspend or restrict access to the relevant membership or program until the outstanding payment has been successfully processed, subject to your rights under the Australian Consumer Law.
We will not charge additional fees for failed payments unless those fees are clearly disclosed to you before they are incurred and are permitted by law.
6. Cancellation
The payment plans for Foundation Athlete and Performance Athlete are fixed-term payment arrangements. They are not automatically renewing subscriptions.
If you wish to stop participating in a membership before all scheduled payments have been processed, please contact us at info@wbsa.org.au
Any request to cancel will be considered in accordance with the terms of your membership, the services already provided and your rights under the Australian Consumer Law.
Where applicable, cancellation may result in the immediate termination of membership access and may not automatically release you from any outstanding payment obligations that form part of the agreed fixed-term payment plan.
Nothing in these Terms & Conditions limits or excludes any rights you have under the Australian Consumer Law.
7. Refunds
Unless otherwise stated, payments are non-refundable once the relevant membership, program, product or service has been provided or commenced, except where you are entitled to a refund under the Australian Consumer Law or another applicable law.
We will provide refunds where required by law, including where goods or services fail to meet applicable consumer guarantees.
Any discretionary refunds will be considered on a case-by-case basis.
8. Membership Access
Membership access is provided for the period and on the terms specified for the membership purchased.
Membership access may be suspended or terminated where:
- payments remain overdue;
- you breach these Terms & Conditions;
- you misuse the membership, website or associated services;
- you engage in unlawful, threatening, abusive or inappropriate behaviour; or
- we are otherwise required or permitted to do so by law.
Where appropriate, we will provide notice before suspending or terminating access.
9. Changes to Memberships and Services
We may make reasonable changes to our memberships, programs, content, facilities or services from time to time.
Where a change materially affects a membership you have already purchased, we will take reasonable steps to notify you and will comply with any rights you have under applicable law.
We will not use these Terms & Conditions to retrospectively change the price, number of payments or material terms of a payment plan you have already entered into.
10. Website and Account Security
You are responsible for maintaining the confidentiality of your account login details and for all activity conducted through your account.
You must notify us promptly if you believe your account has been accessed without your permission.
You must not share your membership access, login credentials or other membership materials with another person unless we have expressly permitted you to do so.
11. Intellectual Property
All content made available through our website or membership programs, including videos, training materials, documents, graphics, photographs, text, branding and other materials, remains our property or the property of our relevant licensors.
You may use membership materials for your own personal use in connection with your membership.
You must not copy, reproduce, distribute, sell, publish, modify or commercially exploit membership materials without our prior written permission.
12. Health, Fitness and Personal Responsibility
Participation in any training, fitness, exercise or athlete program is undertaken at your own risk.
You are responsible for providing accurate information about your circumstances where that information is relevant to your participation.
You should obtain appropriate professional medical advice before commencing physical activity if you have any concerns about your ability to safely participate.
Our programs are not a substitute for individual medical advice, diagnosis or treatment.
13. Limitation of Liability
To the maximum extent permitted by law, we exclude liability for loss or damage arising from your use of our website, memberships, programs or services, except where that liability cannot lawfully be excluded.
Nothing in these Terms & Conditions excludes, restricts or modifies any guarantee, right or remedy that cannot legally be excluded, restricted or modified under the Australian Consumer Law.
14. Privacy
We collect, use and handle personal information in accordance with our Privacy Policy.
By purchasing through our website, you acknowledge that information necessary to process your order and payments may be provided to relevant third-party service providers, including payment processors and technology providers.
15. Third-Party Payment Providers
Payments are processed using third-party payment providers.
Your use of a third-party payment service may also be subject to that provider’s own terms and conditions and privacy policy.
We are not responsible for outages, errors or failures caused by third-party payment providers, except where otherwise required by law.
16. Website Availability
We do not guarantee that our website or online membership services will always be available or free from interruptions, errors or technical issues.
We may temporarily suspend access where necessary for maintenance, security, updates or other operational reasons.
17. Changes to These Terms
We may update these Terms & Conditions from time to time.
The version of the Terms & Conditions that applies to your purchase will generally be the version in effect at the time you place your order, unless a change is required by law or otherwise agreed with you.
18. Governing Law
These Terms & Conditions are governed by the laws of Queensland, Australia.
Any dispute arising in connection with these Terms & Conditions will be subject to the applicable courts and laws of Queensland and Australia.
